Terms and Conditions
By purchasing through this website or telephone line you agree to be bound by the Terms and Conditions laid out below.
These terms and conditions apply to online transactions or telephone orders only and do not apply to any purchases made in our showrooms.
These conditions do not affect your statutory rights as a Consumer.
- "Buyer" means the Consumer who buys or agrees to buy Goods on this website from Beds and Bedrooms
- "Goods" means all products listed on the order and the order confirmation e-mail
- "Consumer" has the meaning given in section 12 Unfair Contract Terms Act 1977
- "Special Order/Items" mean any Goods that are not held in stock by Beds and Bedrooms and are ordered and/or manufactured specifically for the Buyer.
- "Delivery" means the delivery of the Goods to the delivery address specified on the order.
- "Seller" means Beds and Bedrooms.
Any order placed by the Buyer and accepted by Beds and Bedroom is subject to the following terms and conditions.
All orders placed are processed during normal working hours of trade (Monday to Saturday 9-5pm)
Only delivery addresses in KENT will be accepted for orders. We welcome possible orders from Essex, Sussex and South east London but only after contacting Beds and Bedrooms by telephone to talk through your delivery area and if this would be within our acceptable delivery reach, due to not using couriers. Appropriate additional charges will apply see our delivery section.
Limitations of Liability:
Our total liability in regard to the performance of this contract shall be limited to the value of the Goods.
Beds and Bedroom shall not be liable for any direct, indirect or consequential losses, costs or expenses incurred or any consequential compensation arising out of the performance/or non performance of this contract.
Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation or any other liability which may not otherwise be limited or excluded under applicable law.
All contracts shall be governed by English Law.
A confirmation of your order will be sent automatically by e-mail and, unless you are notified to the contrary within 48 hours of this confirmation, the order will be deemed to be accepted Beds and Bedroom.
Beds and Bedroom retains the right to refuse any order that is subject to an error on its website and will in these circumstances reimburse the Buyer in full.
If the seller is not able to supply the product and payment has already been made by the buyer, then following agreement between the seller and buyer, the buyers account will be refunded or re credited with the sum paid by the buyer. The refund will be carried out as soon as possible, in any event, within 30 days of the order. The seller will not be obliged to offer any compensation for disappointment or inconvenience suffered.
Description of goods:
The description of the goods will be as specified within the confirmation e-mail and it is the Buyers responsibility to check that the Goods specified are as the Buyer intended to order.
All sizes given are approximate and the Buyer should satisfy them self that the goods will fit into the delivery address. The normal bed and mattress sizes (i.e. 3, 0" single 4'6" double and 5'0" king) refer to the sleeping surface only and the Buyer should check the overall dimensions given for each product.
Please be aware that mattress sizes may vary slightly from their stated dimensions due to manufacturing tolerances and while most single mattresses will fit a bunk bed, often top bunks require a thinner mattresses (typically no more than 15cm) to ensure safety.
There may be certain items included in the illustration of a product which are not part of the product and are not included in the product description and are not part of the order, (for example, bedside tables, lamps and bedcovers).
All Prices and charges on this site are in U.K. pounds and include any V.A.T payable at the prevailing rate.
We accept credit cards/debit cards, Visa, Delta, MasterCard, Maestro, we do not accept American Express or Diners Club. Full payment will required at time of ordering. You must confirm that the credit or debit card that is being used is yours in order to purchase product(s) on our website or over the telephone. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not for any reason, authorise payment to us, we shall be permitted to cancel our Contract with you.
Beds and Bedrooms retains the right to investigate any order placed that it suspects to be fraudulent, any such order will not be delivered until it is proven that that the order is bona fide. Should Beds and Bedrooms be unable to prove that an order is bona fide or to contact the Buyer then the monies will be refunded to the original card used to place the order and the order will be cancelled.
For your protection, tothat your credit, debit or charge card is not being used fraudulently, we will validate your name, address and other personal information supplied by you during the order process against appropriate third party databases.By accepting these terms and conditions you consent to such checks being made.In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information.Please be assured that this is only done to confirm your identity.
A credit check is not performed and your credit rating will be unaffected.All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.
Cancellations and refunds
The buyer may cancel the goods purchased from our website or via the telephone internet sales department, if the cancellation is received in writing within 7 working days after the delivery.
Special orders may not be cancelled, these are goods ordered/manufactured specifically for the buyer i.e. not held in stock by Beds and Bedrooms.
Due to the intimate nature of Beds, mattresses, sofa beds, divans, headboards, pillows, mattress protectors, duvets etc also flat pack furniture that has been opened, partially or fully assembled, these items are exempt from the statutory 7 day cooling off period under the Distance Selling Regulations when they have been unsealed. Therefore, for reasons of health and hygiene any beds, mattresses or bedding that has been unsealed will be deemed to be used and cannot be returned for any reason other than a manufacturing fault.
The Buyer must retain the Goods and take good care of them until they are collected by Beds and Bedrooms in the original packaging and in the original condition at a time requested by Beds and Bedrooms (this request not to exceed 21 days from the cancellation date).
There is a collection charge which will be the equivalent of the original delivery charge to collect the Goods, the collection charge will be deducted from the refund value. Or the Buyer may return the Goods (at the Buyers cost) unused, to us at Beds and Bedrooms, 21-23 New Road, Chatham, Kent, ME4 4QJ in.the original packaging and in the original condition. The buyer must have a suitable sized transport for returning goods as sprung mattresses must not be folded or bent in a vehicle to return as this will damage the spring system. Goods damaged while returning them to the seller will not be refunded.
Should the Goods not be adequately packaged at the time of collection then they will not be collected and Beds and Bedrooms retain the right to charge a further collection fee to cover costs incurred. The "re-collection" charge will be deducted from the refund value.
Following collection or return, should Goods be found to be damaged (not in their original condition), and the Damage is not the result of our actions or negligence, Beds and Bedrooms will deduct a reasonable amount from the refund to cover such damage. (such amount not to exceed the price of the Goods).
Should the buyer unreasonably fail or refuse to make the Goods available to us when requested within 21 days then the Goods must be kept and good care taken of them until they are collected or returned.
No refund shall be made until the Goods have been collected/returned and inspection made as to their condition, inspection may not always be made on the same day as collection/return.
All prices on our website are exclusive of delivery charges which will be added to the price of the products. We reserve the right to add any congestion charge. Parking fee, or road toll necessary to effect a delivery to your property.
Delivery will normally take place within the timescale estimated on the order acknowledgement (and in any case within 60 days), however this is only an estimate and time shall not be the essence of any order.
When ordering special orders/items an approximate delivery time scale will be provided, whilst every effort will be made to ensure the estimated dates are met they do not form a fixed term of the contract. Any dates and time we specify for the delivery of the goods are approximate only and we shall not be liable for any losses, costs, charges, damages or expenses caused by any delay for the delivery of the goods. Such delays could be a result of, but not limited to:
- Holiday periods i.e. Christmas, Easter
- Inaccessibility i.e. road closures
- Incorrect details provided by the buyer
- Unforeseen circumstances such as strikes, fire, flood, vehicle breakdown, delays by suppliers, fuel shortages etc.
Where possible the seller will try to contact the buyer to advise them in advance of such circumstances. It is the responsibility of the buyer to make the seller aware of any access or delivery restrictions at the time of purchase so that reasonable steps can be made in advance of delivery.
Delivery is officially to the front door only but goods may be taken to the room of the choice at the drivers discretion if access is clear.
It is the customers responsibility to ensure the goods can pass through the doorways, hallways and staircases. In the event of restricted access the delivery staff will leave the goods at the nearest convenient point for the customer.
While the utmost care is taken when delivering goods, it is the responsibility of the buyer to make sure walls and flooring etc are adequately protected / covered at the time of delivery. Beds and bedrooms accept no responsibility for damage caused to the buyers property as a result of the goods being delivered.
Most goods will require some form of assembly and it is the buyers responsibility to assemble the goods. The driver cannot offer assistance of assembly/disassembly of any goods without prior arrangement.
Delivery will only be made to the delivery address specified on the original order.
Delivery will be deemed to have taken place when the goods have been delivered to the agreed address (Beds and Bedrooms do not need to satisfy themselves that the person accepting delivery at the agreed address is authorised by the buyer to accept the goods)
If the buyer fails to give adequate delivery instructions and/or inform us that there are errors in the order acknowledgement and/or confirmation relating to the delivery address details. Or that the agreed delivery day is not convenient and as a consequence the buyer fails to take delivery of the goods whenever a delivery is made. Then Beds and Bedroom can arrange a re-delivery. The cost of the re-delivery will be equal to the original delivery charge or a minimum of £24.50.
Guarantees and faulty goods
All goods are guaranteed against faulty materials and workmanship for a minimum period of twelve months from the date of delivery. In the rare event that goods develop a fault Beds and Bedroom retain the right to have the goods repaired or replaced at Beds and Bedroom discretion and any delivery costs incurred with the exchange will be met by Beds and Bedrooms.
Complaints relating to faulty goods should be notified in writing within 7 days of the fault becoming apparent and should be addressed to Customer Service Department, Beds and Bedrooms, 21-23 New Road, Chatham, Kent ME4 4QJ.
Where it has been reported goods are faulty Beds and Bedrooms retain the right to arrange an inspection. If upon inspection the goods are found not to be faulty but as a result of examples below then any guarantee may in some circumstances be null and void.
- Use other than domestic, excessive soiling or unsanitary condition
- Normal ageing or wear and tear including mattress settlement and dipping
- Deliberate or accidental damage including the manufacturer's instructions not being followed or misuse such as standing/jumping on mattresses and bedsteads.
- Sprung mattresses being folded/bent or being sat on the edge for longer periods of time other than getting in and out of bed.
- Goods being repaired by persons not authorised by Beds and Bedrooms or without prior consent
- Overloading divan drawers
- Goods being assembled incorrectly
Any service Beds and Bedrooms supplies for goods are solely for products brought and used in Kent
